LOS ANGELES: Kanye West and Kim Kardashian are accusing a YouTube co-founder of illegally publishing video of their engagement party to boost his new "foundering" website.
A lawsuit filed Thursday by the celebrity couple blasts Chad Hurley, accusing him of secretly recording West's surprise proposal to Kardashian in the middle of San Francisco's AT&T Park on October 21. The video shows West kneeling near second base to ask Kardashian to marry him while a large orchestra plays in centre field.
The leak diminishes the value of the video of the event that Kardashian and West own, the suit said. Hurley "finagled entry" into the birthday party that West threw for his girlfriend, although only "several dozen people" were invited, the lawsuit said. Although he tagged along with someone who was invited, he was permitted to stay "only after giving his word -- including in writing -- that he would not publish any aspect of the event." The court filing includes a photo of Hurley purportedly holding the signed confidentiality agreement in his hand.
"Immediately after giving his word to honour the condition required for his attendance at the event," Hurley posted the shaky video on MixBit, a video sharing website owned by his San Mateo, California, company, it said. The lawsuit slammed Hurley, 36, as a failed entrepreneur who leaked the video "out of desperation." "Despite his extraordinary financial success in creating YouTube, which was sold in 2006, Hurley has ever since sought his 'second act,'" the lawsuit said.
"This has become exceedingly elusive to Hurley." It cites his failed Formula One racing team and his "Web service named Zeen, which also failed and has been slated for closure in 2013." His newest venture -- MixBit -- "also quickly ran into trouble" after launching in August, the lawsuit contends. "Following a lacklustre launch and unsuccessful ensuing debut, Hurley sought to salvage MixBit from its dour beginning," the suit said.
"An opportunity to do so appeared to Hurley when he learned of the October 21, 2013, event featuring West and Kardashian," it said. The video is titled "PLEEESE MARRY MEEE!!! Congrats Kim and Kanye!" It is still posted on the website, and the counter indicates it has been viewed 1.6 million times. Hurley knows better, the lawsuit said. The terms of service on his own website warn users against posting any video that would violate copyrights, it said.
"Undeterred by the contractual restrictions to which he had just agreed, Hurley opted to exploit and capitalize upon the extreme public interest he knew would attach to the event, in order to boost the fortunes or his underperforming business venture," the suit said. "Saya tahu ramai yang tidak memahami konsep muzik hip-hop yang menjadikan lagu lain sebagai sampel dalam sesebuah karya yang dihasilkan.

PETALING JAYA: A KTM Komuter train derailed near the Rawang KTM station on Friday morning, but fortunately no one was injured in the incident. A source told The Star that the train derailed at approximately 10.15am.
Keretapi Tanah Melayu Berhad (KTMB) president Datuk Elias Kadir confirmed the incident, adding that he was on the way to the station at the moment. Arriving at the scene at about 12pm, The Star noticed that the first of the three coaches of the derailed Electric Multiple Unit (EMU) had run off an inner track and was sitting on an outer track. A Rawang local who wanted only to be known as Fauzi, 24, said the train derailed when it was switching tracks.
He said the train was at the time coming from Tanjung Malim and was on its way to the Rawang station. "The first coach was following the outer track, but the other two coaches were on the inner track," he said. Fauzi said that the train was carrying about 50 passengers when it derailed, though he said no one was hurt. When asked where the passengers were, he said they had been transferred to another train to continue their journey. 
At around 1.35pm KTMB workers separated the two rear coaches from the EMU and attached it to a locomotive. The locomotive than successfully pulled the two coaches away from the first derailed coach.

KLANG: This year’s Deepavali is supposed to be an extra special occasion for Harimau Muda A winger D. Saarvindran as he will be celebrating his 21st birthday on Nov 4 – just two days after the festival of lights on Saturday.
However, the youngster won’t be celebrating his birthday as the Harimau Muda A squad left for Phnom Penh, Cambodia, on Thursday to play in the Mekong Region BIDC Cup. The tournament is from Nov 2-10. But Saarvin will not be returning home after the tournament because the team will then travel to Amman, Jordan, for two friendly matches.
They will only be back home on Nov 20. The 20-year-old said that he was used to being away from the family as “it’s part and parcel of being a professional player”. However, his family, especially his mother S. Maheswary, have yet to come to terms with him being away on such occasions. “This will be the third time that I’ll be missing Deepavali. I was with the team in China in 2009 and Slovakia in 2010 ... so, I’m kind of used to being away on festive occasions,” said the Klang local.
“My mum is a bit upset because my 21st birthday is just around the corner, but I’ve spoken to her and convinced her that I’ll hold a belated birthday celebration if the team win the SEA Games gold medal.” Saarvin said that Deepavali for him usually starts with an oil bath, given by his 78-year-old grandmother S. Segapee, before attending prayers at home and at the temple. The youngster said that they would usually head to his aunt’s home nearby for breakfast before returning home to enjoy lunch. 
That is also when they would entertain family and friends who come visiting. “I will miss the atmosphere and my mother’s special Deepavali dishes but I’ve asked her to cook for me when I return home,” said Saarvin. “I have also told my mother to hide some of the cookies and murukus from my siblings.” The winger is expected to take on a bigger role after a positive showing in the National Under-23 team’s triumph in the Merdeka Tournament in September.
First choice winger Wan Zack Haikal Wan Nor has been ruled out of the SEA Games with an anterior cruciate ligament injury and this has paved the way for Saarvin to claim the right wing spot. “I feel sorry for Wan Zack ... it’s a blow to lose a player of his quality and we will miss him. His absence means others now have a chance to earn a spot in the team.”

SHANGHAI- Golf Channel television pundit Brandel Chamblee was out of order earlier this month when he implied world number one Tiger Woods had cheated, Rory McIlroy said on Thursday. In a column, former U.S. PGA Tour winner Chamblee graded several golfers for their seasons.
Of Woods, he wrote: "He won five times and contended in majors and won the Vardon (Player of the Year) Trophy and ... how shall we say this ... was a little cavalier with the rules". Woods has threatened to sue Chamblee over his remarks and world number six McIlroy jumped to the defence of the 14-times major champion by urging the Golf Channel to take action against the pundit.
"He was out of line and something should be done about it (by) the Golf Channel, that's who Brandel is employed by and they are the ones that can deal with it," the Northern Irishman told reporters after taking the first-round lead at the WGC-HSBC Champions Tournament. "I'll let the Golf Channel executives think what the right way is," added McIlroy, referring to Chamblee's full-time employer although the comments were made on golf.com which is not affiliated to the TV network.
American Chamblee, who has been an outspoken critic of Woods's swing, has already announced he will stop his golf.com column at the end of the year and instead write only for golfchannel.com.Woods has been involved in a few rules controversies this season, most notably at the U.S. Masters in April where he dropped his ball in an incorrect spot after taking a penalty from a hazard at the 15th hole.

Artis-artis berkenaan iaitu Pekin, Izzue Islam dan Neelofa berkata, Pahang layak menerima mata berkenaan berdasarkan kekuatan yang dimiliki oleh pasukan Red Warriors yang disokong mereka.
Sementara itu artis-artis Pahang pula iaitu Azhar Sulaiman, Norkhiriah dan Norman Hakim menaruh keyakinan negeri itu mampu menjuarai perlawanan kali ini kerana mereka dilihat semakin kuat apabila berjaya mara ke peringkat akhir. Ketiga-tiga artis Pahang itu berpendapat Piala Malaysia pada tahun ini wajar jatuh ke tangan skuad Tok Gajah itu setelah sekian lama negeri itu tidak menjadi juara.

PETALING JAYA: Artis-artis dari negeri Kelantan memberikan Pahang dengan mata ‘0’ dalam perlawanan bola sepak Piala Malaysia melibatkan kedua-dua negeri itu di Stadium Shah Alam, dekat sini pada Ahad ini. Artis-artis berkenaan iaitu Pekin, Izzue Islam dan Neelofa berkata, Pahang layak menerima mata berkenaan berdasarkan kekuatan yang dimiliki oleh pasukan Red Warriors yang disokong mereka.
Sementara itu artis-artis Pahang pula iaitu Azhar Sulaiman, Norkhiriah dan Norman Hakim menaruh keyakinan negeri itu mampu menjuarai perlawanan kali ini kerana mereka dilihat semakin kuat apabila berjaya mara ke peringkat akhir. Ketiga-tiga artis Pahang itu berpendapat Piala Malaysia pada tahun ini wajar jatuh ke tangan skuad Tok Gajah itu setelah sekian lama negeri itu tidak menjadi juara.

"Perlawanan kali ini pastinya sengit apabila melihatkan pasukan Pahang kerana mereka semakin hebat di padang.
"Tetapi saya yakin bahawa Kelantan masih boleh mengekalkan kejuaraan mereka. Penyerang Fakri Shaarani merupakan pemain kegemaran saya dan saya yakin dia mampu memberikan satu skor," katanya. Pekin Ibrahim pula mengharapkan Kelantan dapat menundukkan Pahang dengan 2-0 dan yakin pemain kegemarannya, Indra Putra mampu memberikan persembahan permainan yang terbaik pada perlawanan itu. "Saya yakin Kelantan boleh menang kali ini cuma sayangnya saya tidak dapat berpeluang menyaksikan perlawanan tersebut di stadium kerana sibuk di set penggambaran.

Manakala Neelofa yakin Kelantan mampu membawa pulang kejayaan sebanyak 3-0 namun menasihati para penonton agar tidak terlalu beremosi andai kata negeri itu tewas. "Saya faham, bagi masyarakat Kelantan, permainan bola sepak merupakan perkara yang sangat besar tetapi janganlah sampai terlalu beremosi jika perlawanan itu tidak berpihak pada negeri Kelantan. 
"Jika kalah, tunjukkan kepada masyarakat dengan sikap yang lebih tenang pada perlawanan itu nanti," ujarnya. Sementara itu, pelakon Azhar Sulaiman mengharapkan kemenangan berpihak kepada Pahang kerana ia merupakan pencapaian tinggi buat negeri itu untuk berada di peringkat akhir sejak beberapa tahun lalu. "Saya nampak pasukan Pahang semakin kuat dengan memiliki perancangan teliti dalam setiap permainan. 
"Tambah pula kekuatan pemain-pemain Pahang terletak kepada persefahaman masing-masing yang boleh membaca setiap pergerakan yang dilakukan. "Saya yakin kali ini Pahang menjuarai perlawanan Piala Malaysia dengan mata 2-0," ujarnya. Dalam pada itu, Norkhiriah pula berkata, ini merupakan kali pertama dia bersemangat untuk menyaksikan perlawanan bola sepak apabila ia membabitkan negeri kelahirannya. "Insya-Allah saya dan keluarga akan berkumpul menyaksikan perlawanan itu beramai-ramai. Mungkin Pahang mendapat jaringan 3-2 atau lebih. Siapa tahu," katanya. Norman Hakim pula menyasarkan Pahang mampu mengalahkan Kelantan sebanyak 2-0 namun mengakui perlawanan kali ini amat sengit kerana kekuatan kedua-dua pasukan. 
"Kali terakhir Pahang pernah menang adalah pada tahun 1992 dan perlawanan di peringkat akhir ini pastinya satu perkara yang sangat besar buat pemain-pemain Pahang. "Dan saya percaya mereka juga mengharapkan untuk menang. Apa yang boleh saya cakap, kedua-dua pasukan adalah hebat dan hanya permainan konsisten dan tuah mampu memberikan salah satu pasukan untuk meraih kemenangan," katanya.

James Tague was stuck in traffic in downtown Dallas around noon on November 22, 1963 when he became an eyewitness to history. Then a 27-year-old car salesman, Tague was waiting for John F. Kennedy's motorcade to sweep by.
Riding in an open-top Lincoln Continental, the president, flanked by Secret Service bodyguards, waved to the lunchtime crowd, his wife Jacqueline at his side along with Texas Governor John Connally and his spouse. "I noticed a car with flags on the front fender, coming through the crowd," Tague told AFP ahead of the 50th anniversary of Kennedy's assassination.
"That’s where I remembered that I read about Kennedy being in town that day -- and then here comes a pop of a firecracker," he said. "It turned out it's the first shot. Then there was a pause and then the crack-crack of two rifle shots."


On his right cheek, Tague felt something hit him -- a bullet that had ricocheted off the sidewalk, leaving him with a slight wound and no idea what just happened. Within minutes, a deputy sheriff in plainclothes approached Tague and asked what was going on. 
"I said I didn't know, but we noticed that a motorcycle had stopped over by the grassy knoll, and there's a couple of people talking to the motorcycle policeman," he said. "We got there just in time to hear this man sobbing: 'His head exploded. His head exploded.' And the policeman said: 'Whose head?' And he says: 'The president's head.'"
By then the presidential motorcade had gone, racing the mortally wounded Kennedy to hospital. Along with Connally, who was badly wounded, Tague was the only person injured on a fateful day that still weighs heavily on Americans' hearts and minds.

I waved and said: 'Welcome to Dallas, Mr President,'" he recalled. Allman vividly remembers First Lady Jacqueline Kennedy in "that marvelous pink outfit," waving to the crowd, and Kennedy, "sort of waving" brushing the hair off his face. Then came the "boom" that Allman says he'll recognize "for the rest of my life." "But it didn’t go through my mind (that) this first attempt was a shot.
It was not the flat-cracked sound of a rifle. It was a loud boom sound. It came from in front and directly above," he said.


'I thought at first, well, it's a firecracker ... and then boom! Second shot... "During the first shot I had looked up and on the fifth floor (of the depository) there were three guys hanging out of the fifth-floor window and looking up at the sixth floor.
"I looked up at the sixth floor but things were happening so fast I couldn't tell you if I saw a rifle-bearer or not." On the second shot, Allman saw Kennedy's hands go up to his neck, and heard Mrs Kennedy screaming. Then came a third shot, and "Kennedy did a violent sideways move."
Hugh Aynesworth, "a little put out" for not being assigned to cover Kennedy's visit by his newspaper, the Dallas Morning News, where he was a 32-year-old science and aerospace editor, ventured down to Dealey Plaza on his own because "you don't see a president every day." "The crowd along Main was very heavy, very excited. I couldn't get closer so I kept walking, so that's why I ended up over here" at Dealey Plaza, he said.
"As they passed me, Jackie was so happy she was beaming, Kennedy was waving -- and all of a sudden, I heard what I thought was a motorcycle backfire, but it wasn't a motorcycle," he said. "I can tell the next two were shots from a rifle. I saw people immediately grabbing each other -- some running each direction, some falling down, covering their kids, screaming, crying.
It was a mass hysteria within seconds." Phyllis Hall, a 28-year-old nurse at Parkland hospital, was starting her lunch break when her supervisor cryptically announced that there had been "an accident" in Kennedy's motorcade. "The doors from the outside just blew open," she recalled. "There was a lot of chaos and shouting. Here came a cart with the governor Connally -- he was very gravely injured -- and (then) came the next carriage.
"I would learn a few minutes later this is the one that had the president on it." Hall worked in the emergency ward four years previously, so when a "gentleman carrying a very big gun" took her by the elbow and said "we need you back here," she did not resist. "When we got into Trauma Room One, Mrs Kennedy was standing at the foot of the cart," she said.
"In my estimation, the president was dead on arrival because he was very grayish-blue. He was especially dark blue around his mouth. I felt for vital signs. There were none. I saw no movement. "The other doctors came down. They started to do a tracheotomy... There was nothing to do because just before we stopped the emergency measures, a doctor, a neurosurgeon came down, he came over...
"He lifted up the piece of hair (from Kennedy's head) and that's where I could see that a great amount of brain matter was no longer in the head. It was all over Jackie. It was on the Connallys and I'm told it was all over the cart." President John F. Kennedy, admitted to Parkland hospital at 12:38 p.m. as patient number 24740, was declared dead at 1:00 p.m.

A zombie army marched on Tokyo Tower for Halloween on Thursday, with a one-time sumo grand champion bringing some weight to the gathering of the dead. Around 1,200 people turned out in full make-up to roam the streets in an event organised by a television channel and a local beauty college.
At the front was Akebono, sumo's first ever foreign yokozuna -- grand champion -- whose towering frame dominated the sport in the 1990s. Behind him stood enough sickly and wounded undead to give unsuspecting shoppers lasting nightmares. Yamano Beauty College president Jane Aiko Yamano said the event was a great idea.
"My daughter said 'but Mommy, you have a beauty school, you're supposed to be pretty' and now we're getting dressed up like zombies and scary creatures of the night so that was challenging for me but for our students, I think it was just so perfect," she said. Student Tomoka Yamano, whose ghoulish get-up was of a zombie girl whose heart had been broken, said she was having a wonderful time.
"I don't always get dressed like this but today I put a lot of effort into the make up here on my neck," she said. Halloween, whose roots stretch back hundreds of years in Christian countries, is a relatively recent import to Buddhist and Shintoist Japan. Like Christmas, it is wholly stripped of any religious meaning, but has thrived over the last decade as a fancy dress celebration, with parties and parades everywhere from landmarks to shopping parades. 
"I think Halloween has taken root as a real seasonal event in Japan," said Tsuyoshi Sawada, a spokesman at Tokyo Tower, where visitors were being given witches' hats or axes.

Air France-KLM has climbed sharply away from crisis, its quarterly statement showed Thursday, but the airline group delayed the timetable for getting over its debt mountain while offering help to shaky partner Alitalia.
The French-Dutch airline group, considered at risk of failing two years ago, reported that third-quarter operating profit leapt by nearly a third thanks to restructuring efforts. But the net figure fell by half because of a writedown of the group's 25.0 percent interest in Italian airline Alitalia which has just averted insolvency and needs new capital urgently.
Air France-KLM is restructuring to pull out of deep financial problems and cope with low-cost competition, and chief executive Alexandre de Juniac said that the operating figure was "very encouraging" as a sign that the measures were working. Operating profit jumped by 29.1 percent to 634 million euros ($868.6 million), in line with analysts' expectations and up from 491 million euros in the same quarter last year. Net profit fell to 144 million euros from 296 million euros. 
Air France-KLM along with other shareholders in Alitalia have until the middle of November to decide whether or not to participate in a share of a capital increase of up to 300 million euros. De Juniac told analysts that "we are a loyal partner, we are a serious partner. We want to help them (Alitalia) and there are three conditions."
He said that since talks on recapitalisation began, the French group had been clear about requiring "strict financial, industrial and social conditions" and a "profound restructuring" for Alitalia. If these conditions were met, the French group could "envisage" strengthening the partnership. If not "we will not do so," De Juniac said.
The fall in Air France-KLM's net profit for the quarter reflected a tax charge of 140 million euros and a factor of 137 million euros for its interests in Alitalia. But the restructuring programme at Air France-KLM, called Transform 2015, continued to bear fruit. On the basis of these results, the group held to its targets for the whole of 2013.
In the first half, an operating loss had been reduced by 239 million euros to 451 million euros, and a net loss fell by 33.8 percent to 649 million euros. With the third-quarter boost, for the first nine months of the year the group switched into an operating profit of 183 million euros from a loss of 199 million euros in the same period of last year.
Debt-reduction target delayed to 2015 On the basis that its bill for fuel would be $2.3 billion, and in a highly volatile climate, the group said second-half operating profit would improve in line with performance in the first half. In January 2012, Air France-KLM launched a restructuring programme to save 2.0 billion euros over three years and to reduce debt to 4.5 billion euros by the end of 2014 from 6.5 billion euros at the beginning of 2012.
However, on Thursday the group delayed this timetable. The group said now that given an environment marked by weak growth, volatile fuel prices and exchange rates, and despite a big improvement in long-range operations and maintenance, underlying profit next year would be about 2.5 billion euros. This was at the lower end of the range mentioned previously and the 2.0-billion euro reduction of net debt debt would now be achieved in 2015.
"The group continued to improve its operating result during this quarter," De Juniac said in a statement: "This is very encouraging since it shows that the roll-out of the measures in the Transform 2015 plan is proceeding in line with our expectation. However, the medium-haul and cargo sectors were facing major difficulties.
The airline said that conditions had remained difficult in the third quarter, and in addition the euro had risen strongly, crimping sales figure when converted from other currencies. In the quarter sales edged up by 0.4 percent to 7.21 billion euros.

The fall in Air France-KLM's net profit for the quarter reflected a tax charge of 140 million euros and a factor of 137 million euros for its interests in Alitalia. But the restructuring programme at Air France-KLM, called Transform 2015, continued to bear fruit. On the basis of these results, the group held to its targets for the whole of 2013.
In the first half, an operating loss had been reduced by 239 million euros to 451 million euros, and a net loss fell by 33.8 percent to 649 million euros. With the third-quarter boost, for the first nine months of the year the group switched into an operating profit of 183 million euros from a loss of 199 million euros in the same period of last year.
Debt-reduction target delayed to 2015 On the basis that its bill for fuel would be $2.3 billion, and in a highly volatile climate, the group said second-half operating profit would improve in line with performance in the first half. In January 2012, Air France-KLM launched a restructuring programme to save 2.0 billion euros over three years and to reduce debt to 4.5 billion euros by the end of 2014 from 6.5 billion euros at the beginning of 2012.
However, on Thursday the group delayed this timetable. The group said now that given an environment marked by weak growth, volatile fuel prices and exchange rates, and despite a big improvement in long-range operations and maintenance, underlying profit next year would be about 2.5 billion euros. This was at the lower end of the range mentioned previously and the 2.0-billion euro reduction of net debt debt would now be achieved in 2015.
"The group continued to improve its operating result during this quarter," De Juniac said in a statement: "This is very encouraging since it shows that the roll-out of the measures in the Transform 2015 plan is proceeding in line with our expectation. Setelah drama dan filem, baru-baru ini dia baru sahaja melibatkan diri dengan teater menerusi pementasan Maduku Kalut. 
Selepas Hantu Kapcai yang diterbitkan Showbiz Productions menjadi antara filem yang menaikkan nama Izzue Islam dalam bidang lakonan, dia bakal muncul di layar perak dalam tiga filem terbitan syarikat produksi yang sama penghujung tahun ini. Timbul desas desus mengatakan bahawa Izzue Islam dikatakan anak emas kepada Showbiz Productions dek kerana bakal tampil dalam tiga filem terbitan syarikat tersebut. “Ini sebenarnya kebetulan yang memihak kepada saya apabila filem lakonan saya akan ditayang secara berturut-turut.
Saya bersyukur dengan rezeki yang dikurniakan kepada saya ini,” jelas Izzue yang ditemui ketika majlis doa selamat serta perlancaran 3 filem tersebut di GSC Pavilion baru-baru ini. “Filem-filem ini diarahkan oleh 3 pengarah berbeza dan saya berpeluang menimba pelbagai ilmu. Isu anak emas itu saya harapkan tiada kerana tawaran yang saya terima itu adalah daripada pengarah. Lagipun saya menghadiri casting yang dijalankan dan bukannya nama saya dipilih oleh sesiapa. Saya tidak mahu persepsi diberikan begitu kepada saya.,” jelasnya

Pelakon Datuk Rahim Razali, 71, selamat menjalani pembedahan bagi membuang pendarahan dalam otaknya kira-kira pukul 8 pagi tadi di Pusat Perubatan Sunway di sini.
Laporan mStar Online memetik, anak kepada seniman itu, Nadia Rahim, 41, berkata, pembedahan tersebut dijalankan selama sejam lebih dan bapanya kini ditempatkan di High Dependency Unit (HDU) iaitu tempat pesakit kritikal yang memerlukan pemerhatian selepas menjalani pembedahan. Nadia dalam kenyataannya mengucapkan syukur ke hadrat Allah kerana ayahnya telah selamat menjalani pembedahan dan ia mengambil proses selama sejam lebih.
Dia kini ditempatkan di HDU. Dia ketika dihubungi sedang dalam perjalanan ke hospital untuk melawat ayahnya yang ketika itu sedang ditemani ibunya, pagi tadi. Rahim dimasukkan ke Pusat Perubatan Sunway pada Ahad lalu selepas mengalami sakit kepala ketika menjalani penggambaran rancangan sukan terbitan Astro Arena di Kuantan, Pahang sehingga terpaksa di bawa pulang ke Kuala Lumpur.
Selepas dihantar ke pusat perubatan itu oleh keluarga, pihak hospital terpaksa menahan Rahim apabila ujian sinar X mendapati terdapat kesan darah pada otaknya dikenali sebagai subdural hemorrhage yang perlu dibedah segera.
